I need some advice, where in JHB can I find a non vampiric Lawyer that won't suck my bank dry?
I need a lawyer to possibly take legal actions against for unauthorised debits from my bank account!

Good luck finding one... although i can suggest legal wise... but the fact that you're asking means that you dont have they're cover.
I think Edgars has some legal advisory service as well if you're a club member.

yip its a type of insurance, you cant claim for "damage" thats already there. You can only claim for events that occur after you sign up. Not for a circumstance which currently exists...

mm, i think what the lawyer will say is that you have to lay a criminal charge at the police station first.
Anyway, when my friend needed a lawyer, he had to pay a deposit of something like R7k... ouch

tried that... bank can't... I asked them to BLOCK all future debits from the fekers... yet again they changed their detail and they debited... fek!

By law, the banks shouldn't be allowed to let a debit go through your account unless the debitor cna prove that you have signed a debit order agreement.
Tell them no more debits are to come of your account unless they have seen said forms. Speak to a Manager too, the call centre ppl are programmed to say it can't be recalled.

The bank is liable to pay you for unauthorised debits... they need to have checked that the debit orders were valid and that they were signed by you. If debited to another bank it is unlikely they can reverse the debits outside the waiting period (24hours last i heard).
I recall something a friend who works at a bank told me about floor limits. to handle the volume of transactions these limits are used. If the amount is below a certain value Ie: a debit card transaction with shoprite was R200 the amount goes through on a current account regardless of whether you have the funds available or the credit facility. If you're debited with a small amount a similar rule may apply. as millenia said, speak to the manager or your PR assistant

Not true.
A debit can be successfully recalled anytime as long as none of the funds have been touched. IOW, you get debited for R200, you realise 2 months later and phone the bank. They can issue a recall as long as there hasn't been any money moved OUT of that account. Even if they moved 1 cent you have to go the long arduous route.

Interesting millenia, although i have seen recalls (reversals of deposits) done on some of our clients even after they transacted through their accounts,(standard bank is the only one i can remember)... maybe different banks have slightly policies
