The judge, Lisa Hart Cole ruled that there is no basis behind Britney’s claim and said that her sexualised image cannot be defamed by the claims. “The issue is whether it is defamatory to state that a husband and wife taped themselves engaging in consensual sex,” she said. The judge feels it is not defamatory as “the plaintiff herself has put her modern sexuality squarely, and profitably, before the public eye”.
Britney and Kevin had sought $10 million in damages over the article, which was published in October 2005 and reported that they had watched the video in their lawyers’ office and had been “acting goofy”.
Us Weekly has praised the decision, telling the LA Times that “from the outset, we have stood by our reporting”.
